In accordance with the Constitution of Ukraine and the Law of Ukraine "On the Prosecutor's Office," the Kyiv City Prosecutor's Office performs the following functions:
- procedural guidance of pre-trial investigations in criminal proceedings;
- supervision of investigative and search activities of law enforcement agencies;
- supporting public prosecution in court for criminal offenses;
- representing the interests of the state in court in exceptional cases;
- overseeing the legality of the enforcement of court decisions in criminal cases and in places of detention;
- international cooperation with law enforcement agencies of other countries on issues of extradition and combating international crime.
Since 2014, the prosecution authorities have not been performing the function of general supervision.
According to the Law of Ukraine "On Citizens' Appeals," every citizen has the right to appeal to the Kyiv City Prosecutor's Office with an appeal, which may be verbal or written.
Verbal appeals can be submitted in person or by calling the hotline at (044) 527-72-44.
A written request shall be submitted:
- by mail (03150, Kyiv, 45/9 Predslavynska St.);
- via a box located in the lobby of the administrative building or in person at the reception desk;
- by electronic communication to email: zvern@kyiv.gp.gov.ua or by submitting an electronic application using the form provided on the official website.
The appeal must contain:
- surname, first name, patronymic/name;
- applicant's place of residence/address;
- the essence of the issue raised;
- signature of the applicant, including a qualified electronic signature (only for written requests);
- date;
- email address and other means of communication (only for electronic applications).
It should be noted that the Law of Ukraine "On Citizens' Appeals" does not apply to:
- whistleblower statements;
- applications for participation in the selection of candidates for a position and other applications, the procedure for consideration of which is established by labor legislation;
- applications for free legal aid;
- statements on conducting the verification provided for by the Law of Ukraine "On Purification of Government";
- statements of claim (complaints), other statements or motions in the case, filed in accordance with the CPC (Civil Procedure Code), CPC (Commercial Procedure Code of Ukraine), CAS (Code of Administrative Procedure of Ukraine);
- statements (complaints), petitions submitted in accordance with the CPC of Ukraine (Criminal Procedure Code of Ukraine);
- petitions and complaints in enforcement proceedings;
- complaints (statements) regarding the conduct of a judge, which may result in disciplinary action against him or her;
- statements by persons who did not (do not) participate in the case, if the court decision concerns their rights, freedoms, interests, or obligations, etc.
Appeals are considered within 30 days if their consideration and resolution require additional study; no more than 15 days if the consideration and resolution of appeals do not require additional study; 10 days – for returning an appeal to the applicant that was not drawn up in accordance with the requirements of Article 5 of the Law of Ukraine "On Appeals of Citizens"; 5 days – for forwarding to the appropriate authority if the issues raised therein do not fall within the powers of the prosecutor's office.
The Kyiv City Prosecutor's Office has a reception desk where anyone can submit a request, find out about the progress or outcome of its resolution, obtain necessary information on the activities of the city prosecutor's office, and which is open on working days Monday-Thursday from 9:00 a.m. to 5:45 p.m. and Friday from 9:00 a.m. to 4:30 p.m. Lunch break is from 1:00 p.m. to 1:45 p.m. Closed on Saturdays and Sundays.
The reception area of the city prosecutor's office has been equipped to facilitate communication with hearing-impaired individuals when they submit their appeals.
It is possible to use online sign language interpretation with the help of a special tablet with specialized software installed on it.
Thanks to this device, a professional sign language interpreter can connect to the dialogue between a sign language user with hearing impairment and an employee of the Kyiv City Prosecutor's Office via video link. The interpreter helps to establish communication between the applicant and the prosecutor's office employee to ensure comfortable and accessible access to the necessary services.
The management of the Kyiv City Prosecutor's Office conducts personal appointments with citizens in accordance with the approved appointment schedule, which is published on the official website of the city prosecutor's office, the Unified Open Data Portal, and in the prosecutor's office (citizen reception area). Receptions by the head of the city prosecutor's office and his deputies are conducted by appointment, which begins the day after the previous reception and ends 15 days before the next reception date.
The head of the city prosecutor's office personally receives appeals that have been rejected by his deputies on all issues, or in cases of appeals against their actions or decisions, and the first deputy and deputies of the head of the city prosecutor's office receive citizens on issues of disagreement with actions or decisions taken as a result of consideration of appeals by the heads of independent structural units of the relevant prosecutor's office and the heads of district prosecutor's offices, as well as on issues of delay, prolonged non-acceptance of decisions by them.
The application for a personal appointment must include: the essence of the issue raised, copies of the contested responses to previous appeals, and, if necessary, copies of documents certifying the special status of the person..
Please note that the Law of Ukraine "On Citizens' Appeals" does not apply to the procedure for considering citizens' applications and complaints established, inter alia, by criminal procedural legislation.
